Section 2 – Confidentiality
2.1 The Candidate confirms that all information supplied to the agency is honest, correct and complete, and understands that in order for the Agency to assist the Family in finding an au pair, the Agency can share personal details of the Candidate, as provided to the Agency, with the Family.
2.2 The Candidate agrees that should she have provided fraudulent information to the Agency or the Family, the Agency will at its sole discretion terminate the Candidate from its list of Candidates that are available for placement.
2.3 The Candidate agrees to make payment of the Agency’s registration fee of R150, either in cash or by card at the time of the Candidate’s interview with the Agency. The Agency agrees that the R150 registration cost covers all administrative costs involved with registration, including creation of a new resume / candidate profile for the Candidate (to be used internally in the Agency) and the cost of any background checks (reference, criminal or other). Should the Candidate be experiencing financial difficulty, the Candidate should inform the agency regarding this at which point the agency may decide to allow delayed payment of the fee, or waive the fee.
2.4 The Candidate understands that the Agency may at its sole discretion, even after her interview with the Agency, accept or reject her application. In the unlikely event that the application is rejected, the Candidate will be informed, however he/she will not be entitled to a refund of the Agency registration fee.
2.5 The Candidate authorises the Agency to conduct all background checks, including but not limited to, credit checks, drivers license checks, employment reference checks, academic checks or any other checks that may be necessary in the pre- or post placement process with the Family.
2.6 The Candidate agrees to assist the Agency in obtaining a Police Clearance Certificate should it be deemed necessary by the Agency or the Family, unless a valid Police Clearance Certificate not older than six months is provided to the Agency by the Candidate.
2.7 The Candidate agrees to make herself available for interviews with prospective families, and to, at all times, attempt to accommodate for interview times requested by these families or by the Agency. Cancelling or attempting to change interview times on short notice (within 48 hours of the scheduled interview) is strongly discouraged and may result in disqualification of the Candidate’s registration with the agency.
2.8 No Candidate is permitted to share her personal contact details or any contact details of her family, friends or acquaintances with Family prior to finalisation of employment. This includes telephone numbers, cell phone numbers, social media accounts or account names, Skype numbers, e-mail addresses, residential address or any other contact details.
2.9 The Candidate agrees not to contact the Family directly at any point prior to finalisation of employment, unless authorised to do so in writing by the Agency. Should the Family in turn attempt to contact the Candidate prior to finalisation of employment, the Candidate agrees to inform the Agency immediately.
2.10 The Candidate accepts that the selected Family has been selected by themselves and is strongly advised to satisfy herself as to the suitability of the Family.
2.11 If the Family makes an offer of employment directly to the Candidate and the Candidate accepts the offer, the Candidate agrees to notify the Agency of this immediately either verbally or in writing.
2.12 The Candidate will not accept employment directly from the Family to the exclusion of the Agency.
2.13 The Candidate understands and agrees that should she, contrary to the terms and conditions of this agreement, accept employment directly from the Family to the exclusion of the Agency, within a twelve month period of having been introduced to the Family by the Agency, she will be personally liable, jointly and severally, with the Family, for the full payment of the placement fee, as if the placement had been made through the Agency.
2.14 Should the Family negotiate and agree a salary directly with the Candidate, she agrees to notify the Agency of this immediately either verbally or in writing.
2.15 The Candidate understands that a contract of employment is entered into between the Candidate and the Family the moment an offer of employment is made, either verbally or in writing, by the Family and accepted, either verbally or in writing, by the Candidate. It is not subject to the actual signing of a written Contract of Employment. The signing of a Contract of Employment is merely a formality and failure to sign one by any party does not make the contract between the parties null and void.
2.16 Once the Candidate has accepted the offer of employment whether in writing or verbally, should the Candidate then repudiate or no longer accept the offer of employment from the Client, prior to the commencement date of employment, the Candidate will be held personally liable for payment of 50% of the placement fee that will as a result need to be refunded to the Client.
2.17 The Candidate agrees, at the request of the Agency, to withhold her services to the Family should the Family have failed to pay the placement fee to the Agency. The Candidate agrees not to commence employment or return to work until the placement fee has been paid in full. The Agency agrees to endeavour to find the Candidate a suitable replacement Family.
2.18 Should the Family negotiate and increase the Candidate’s salary and/or working hours within 90 days form the date that the Candidate commenced working for the Family, the Candidate will immediately inform the Agency of the increase.
2.19 The Candidate indemnifies the Agency and its staff against any loss, harm or damages she may incur as a result of the services that she renders to the Family.
Section 3 – Engagement Terms And Exchange Of Contact Details
The Candidate agrees to the following:
3.1 Not to permit any of her family and friends into the Family’s home nor to permit them to be around the Family’s children at any time without the prior knowledge and approval of the Family.
3.2 To behave in a responsible, caring and considerate manner whilst caring for the Family’s children.
3.3 To respect the Family’s morals and values.
3.4 To neither physically nor psychologically hurt nor abuse the Family’s children in any way whatsoever. Should she be found to have committed an offense in this regard, criminal charges may be brought against her.
3.5 Not to smoke in the Family home, car, nor in the presence of the Family’s children.
3.6 Not to meet up with her family or friends nor permit the her family or friends to be around the Family’s children at any time without the prior knowledge and approval of the Family.
3.7 Not to permit any of her family, friends or strangers to travel in the motor vehicle whilst she is traveling with the Family’s children.
3.8 Not to use the Family’s motor vehicle for personal use without the prior approval of the Family.
3.9 Not to use the Family’s telephone or cellular phone for personal use without the prior approval of the Family.
3.10 Not to use the Family’s internet for personal use without the prior approval of the Family.
3.11 To abstain from the use of any illegal drugs.
3.12 Not to take care of, nor to be in the presence of the Family’s children whilst consuming alcohol.
